Marriage and stable union in Brazil

What are the types of marriage and what characterizes each one?

Civil marriage – It is the union between two persons, who establish full communion of life, based on equal rights and duties. It is held in the Civil Registry Office, in a process that begins with the couple’s qualification through documentary analysis and publication of the wedding proclamations in the local press or in the office’s mural. The union’s officialization is carried out by a peace judge in the presence of witnesses. Once the ceremony is held, a Marriage Certificate is issued, a document that formalizes the marriage.

Religious Marriage – It is celebrated according to the rite of each belief before religious authority. If not accompanied by registration in the registry (religious marriage with civil effect), the union is not legally formalized and the couple remain with the marital status of single.

Religious marriage with civil effect – Occurs when, after the religious celebration, the couple present, within 90 days, the marriage term issued by the religious authority for formalization before the civil registry. In this modality, it is also necessary to qualify the parties in the notary’s office (documentary analysis), as occurs in civil marriage.

What is stable union?

It is the relationship between two people that is characterized as a public, continuous and lasting coexistence and that has the purpose of family constitution. The legislation does not establish a minimum period of coexistence for a relationship to be considered a stable union. There is also no need for the couple to live in the same room for the bond to be set up. Other elements can be considered for its characterization, such as the existence of children.
